President Joko Widodo’s Government (Jokowi), Wednesday (1/4/2020) officially issued a Government Regulation (PP) on Large-Scale Social Restrictions (PSBB). The PP regulates the procedure for determining PSBB and its requirements. The PP is stated in PP No. 21 of 2020 concerning Large-Scale Social Restrictions in the Framework of Accelerating Handling of Corona Virus Disease 2019 (COVID-19).
In accordance with the law (UU), the PSBB is stipulated by the Minister of Health in coordination with the Head of the Covid-19 Task Force and regional heads. The legal basis is Law No. 6 of 2018 concerning Health Quarantine.
In his discussion, according to Dr. Rodiyah, Dean of the Faculty of Law, Semarang State University and also as an expert in Constitutional Law, the PP issued by the government in order to accelerate the handling of Covid-19 was clearer and also based on the rescue of civil society in a democratic country so that it was in accordance with the characteristics of the community. and the demographic and geographical and socioeconomic country of Indonesia. Rodiyah hopes that the public will be disciplined to apply the Covid-19 subscription standard so they can decide on the spread of the virus,
Continuing from the discussion, Dani Muhtada PhD, Lecturer in State Administration and State Administration Law, expressed his gratitude and relief. According to him, using Law Number 6 Year 2018 on Health Quarantine is far more relevant for democracy and the rule of law than Perppu Number 23 of 1959 concerning Dangerous Conditions.
“The use of Law Number 6 Year 2018 on Health Quarantine is a very strong legal basis that gave birth to PPs and Presidential Decrees as an appropriate implementation at the same time relevant to democracy and the rule of law than Perppu Number 23 of 1959 concerning Dangerous Conditions”, said Dani Muhtada in his discussion.
Dani Muhtada added that if this legal basis was not able to overcome Covid-19 emergencies, he continued, it could be Perpu Number 23 of 1959 concerning Dangerous Conditions and the extraordinary risks if it were carried out, hopefully not.
